Acceptance of Terms of Use
OneStarRewards.com, the "One Star Rewards® website," and CherokeeCasino.com, the “Cherokee Casino website,” (collectively the “Cherokee Nation Entertainment Websites”) are comprised of various webpages operated by Cherokee Nation Entertainment, LLC ("CNE").
The Cherokee Nation Entertainment Websites and Communication Services, as hereinafter defined, are offered to you conditioned on your acceptance without modification of the terms, conditions and notices contained herein. Your use of the Cherokee Nation Entertainment Websites and Communication Services constitutes your agreement to all such terms, conditions and notices. The Cherokee Nation Entertainment Websites and Communication Services are not intended for use by any person under the age of 21 unless under the direct supervision of that person's parent or legal guardian.
Modification of these Terms of Use
CNE reserves the right to change these terms, conditions and notices, under which the Cherokee Nation Entertainment Websites and Communication Services are offered, at any time without prior notification, including but not limited to the charges associated with the use of any Cherokee Nation Entertainment Website and/ or Communication Service.
Proprietary Content
Cherokee Nation Entertainment, LLC, has all rights, title and interest in the content located on any Cherokee Nation Entertainment Website or Communication Service, including but not limited to, all logos, graphics, audio, video, documents, images or other materials ("Content"). Content displayed on any Cherokee Nation Entertainment Website or Communication Service is the property of Cherokee Nation Entertainment, LLC, or third parties. You may not copy, use or display this Content without the express written approval of Cherokee Nation Entertainment, LLC.
Links to Third Party Websites
The Cherokee Nation Entertainment Websites may contain links to other websites ("Linked Sites") and these Linked Sites are provided for ease of use only. The Linked Sites are not under the control of CNE and CNE is not responsible for the content of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. CNE is not responsible for webcasting or any other form of transmission received from any Linked Site. CNE is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by CNE of the site or any association with its operators.
Unlawful or Prohibited Use
As a condition of your use of the Cherokee Nation Entertainment Websites and Communication Services, you warrant to CNE that you will not use the Cherokee Nation Entertainment Websites or Communication Services for any purpose that is unlawful, for discussion of illegal activity, and/or for purposes prohibited by these terms, conditions and notices. You may not use the Cherokee Nation Entertainment Websites or Communication Services in any manner that could damage, disable, overburden, or impair the Cherokee Nation Entertainment Websites or Communication Services or interfere with any other party's use and enjoyment of the Cherokee Nation Entertainment Websites or Communication Services. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Cherokee Nation Entertainment Websites or Communication Services.
Use of Communication Services
Bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities contained on a Cherokee Nation Entertainment Website and any other means of electronic messaging or communication originated by Cherokee Nation Entertainment designed to enable you to communicate with the public at large or with a group; or facilitate communication between you and Cherokee Nation Entertainment are collectively, referred to as "Communication Services". You agree to use the Communication Services only to post, send and receive messages and materials that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:
CNE has no obligation to monitor the Communication Services. However, CNE reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. CNE reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.
CNE reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in CNE's sole discretion.
Always use caution when giving out any personally identifiable information about yourself or your children in any Communication Service. CNE does not control or endorse the content, messages or information found in any Communication Service and, therefore, CNE specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized CNE spokespersons, and their views do not necessarily reflect those of CNE.
Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.
Materials provided to and/or through the Cherokee Nation Entertainment Websites or Communication Services
CNE does not claim ownership of the materials you provide to CNE (including feedback and suggestions) or post, upload, input or submit to any Cherokee Nation Entertainment Website or Communication Service (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission, you are granting CNE, its affiliated companies and necessary sublicensees permission to use your Submission, in connection with the operation of their websites, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission. By posting, uploading, inputting, providing or submitting your Submission, you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions. No compensation will be paid with respect to the use of your Submission, as provided herein. CNE is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in CNE's sole discretion.
When you complete forms online or otherwise provide CNE information in connection with the Cherokee Nation Entertainment Websites or Communication Services, you agree to provide accurate, complete and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If CNE, in its sole discretion, believes that any such information is untrue, inaccurate or incomplete, CNE may refuse you access to any Cherokee Nation Entertainment Website or Communication Service and pursue any appropriate legal remedies.

CNE MAKES NO CLAIMS, ASSURANCES, OR GUARANTEES ABOUT THE ACCURACY, SUITABILITY, COMPLETENESS OR ADEQUACY OF THE INFORMATION, SOFTWARE, PRODUCTS, RELATED GRAPHICS AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE CHEROKEE NATION ENTERTAINMENT WEBSITES OR COMMUNICATION SERVICES. INACCURACIES OR TYPOGRAPHICAL ERRORS MAY EXIST ON A CHEROKEE NATION ENTERTAINMENT WEBSITE OR COMMUNICATION SERVICE AND CNE WILL NOT BE RESPONSIBLE FOR RELIANCE ON SUCH INFORMATION. Termination of Use or Access Restriction
CNE reserves the right, in its sole discretion, to terminate your access to any Cherokee Nation Entertainment Website or Communication Service and the related services or any portion thereof at any time, without notice. This agreement is governed by the laws of the Cherokee Nation. By using this website, you consent to the exclusive jurisdiction and venue of courts in Cherokee Courts in Tahlequah, Oklahoma, for all disputes arising out of or relating to the use of any Cherokee Nation Entertainment Website or Communication Service. No business relationship, employment or agency relationship exists between you and CNE as a result of this agreement or use of the Cherokee Nation Entertainment Websites or Communication Services. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and CNE with respect to the Cherokee Nation Entertainment Websites and Communication Services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and CNE with respect to the Cherokee Nation Entertainment Websites and Communication Services.
Indemnity
You shall defend, indemnify and hold CNE harmless from and against any and all claims, losses, damages, suits, judgments, fines, penalties, or any other loss including costs, expenses and attorneys' fees arising out of or occurring in connection with your use of this site. The foregoing indemnification obligations shall include without limitation claims, losses, damages, suits, judgments, fines, penalties, or any other loss including costs, expenses and attorneys' fees arising out of or occurring in connection with your breach of these terms of use, infringement or violation of the right of any person, such as under any patent, trademark or copyright laws. All indemnifications provided herein shall extend to the officers, directors, employees and agents of CNE.
